1General provisions
By using Wilkoop, the user confirms that he has read, understood and accepts the Terms of Use, Privacy Policy, Cookie Policy, Platform Rules and other documents published on Wilkoop.
If a user does not agree to these terms, they should not register, post ads, purchase products, or use platform features.
Wilkoop can update conditions. The current version is always posted on the website. Continued use of the platform after the publication of a new version constitutes acceptance of the updated terms, unless separate consent is required by law.
2Role of Wilkoop
Wilkoop is an online technical platform that helps users find products, communicate, transact, receive notifications, order history and other functions.
Wilkoop is not the seller, buyer, owner of the goods, manufacturer, carrier, bank, payment institution or insurance company.
Unless expressly stated otherwise, the contract of sale is concluded directly between the seller and the buyer. Wilkoop does not guarantee the quality, condition, authenticity, safety or legality of each item.
3User account
The user is obliged to provide accurate data, protect access to the account and not transfer it to third parties.
It is prohibited to use other people's data, create accounts to bypass blocking, impersonate another person, or hide information necessary for the security of a transaction.
Wilkoop may limit, temporarily block or delete an account if there are signs of fraud, violation of rules, illegal activity, security risks or abuse of platform functions.
4Announcements
The seller is responsible for the description, photographs, price, category, condition of the product, availability of the product and the right to sell the product.
The advertisement must be honest and understandable. You cannot post other people’s photographs without the right to use them, hide significant defects, indicate a false price, or mislead buyers.
Wilkoop may hide, restrict or remove advertisements that violate the law, the rights of third parties, platform rules or pose a risk to users.
5Prohibited goods and activities
Illegal, dangerous, stolen, counterfeit or other goods that violate the law, the rights of third parties or platform rules are prohibited on Wilkoop.
Fraud, threats, spam, extortion, publication of other people's personal data, bypassing security systems, malicious links, cheating reviews and abuse of complaints or disputes are also prohibited.

6Transactions, payments and paid services
Users independently decide on price, purchase, sale, delivery and other terms of the transaction.
Wilkoop may provide tools for orders, payments, balances, ad promotions and other paid services. Payments may be processed by external payment providers.
Wilkoop is not a bank. Internal balance, if available, is for use on the platform only and is not a bank deposit.
Wilkoop may temporarily restrict payment, balance, payouts or certain functions if there is a dispute, chargeback, suspected fraud, technical error, payment provider requirement or legal requirement.
7Payments to sellers
If the payment function is available, the seller is obliged to provide reliable data and undergo verification if required by law, payment provider or Wilkoop rules.
Wilkoop may delay or refuse payment in the event of a dispute, chargeback, suspicion of fraud, violation of rules, error in user data or requirement of competent authorities.
8Delivery and transfer of goods
If delivery is arranged by users themselves, they are responsible for packaging, address, timing, shipping confirmation and receipt of goods.
If Wilkoop provides shipping integration, this does not make Wilkoop a carrier. Users should retain receipts, tracking numbers, photographs of packaging and other evidence.
9Disputes and returns
The user can contact support or open a dispute if such a function is available. Wilkoop can take into account the ad description, correspondence, payment status, delivery data, photos, videos, technical logs and account history.
The resolution of the dispute depends on the available evidence, the nature of the transaction, the status of the seller, the method of payment, the method of delivery and the applicable law.
If the seller is a professional seller, he is independently responsible for compliance with consumer protection regulations, warranties, returns, taxes, labeling and mandatory information.
10Moderation
Wilkoop may take measures against violations: warning, removal of content, restriction of messages, temporary blocking of functions, cancellation of a transaction, withholding of payment, blocking of an account or transfer of information to the competent authorities if there are legal grounds.
Wilkoop strives to take action proportionate to the violation, but may act immediately if there is a serious risk to users or the platform.
11Intellectual property
Design, interface, logos, brand elements, structure, program code and original materials of Wilkoop belong to Wilkoop or are used legally.
By posting content on Wilkoop, the user grants the platform the right to store, display, adapt and use this content for service operation, security, ad promotion and technical functioning.
The user guarantees that he has the rights to photographs, descriptions and other materials that he posts.
12Availability and responsibility
Wilkoop strives to maintain the stable operation of the platform, but does not guarantee the absence of errors, maintenance, temporary unavailability, data loss or device incompatibility.
To the fullest extent permitted by law, Wilkoop is not responsible for user actions, quality of goods, accuracy of listings, delivery, delays, damages, lost profits, user errors, actions of third parties or user fraud.
The limitation of liability does not apply in cases where the law expressly prohibits such limitation.
13Discontinuation of use
The user may stop using Wilkoop and request account deletion.
Wilkoop may retain some data if necessary for legal, accounting, fraud prevention, dispute resolution, or to protect the rights of Wilkoop or other users.
14Applicable law
Unless mandatory consumer protection regulations provide otherwise, these terms and conditions are governed by Belgian and European Union law.
Disputes will be dealt with by the competent courts of Belgium unless the applicable law provides the user with other mandatory rights.
